But what does it mean in concrete terms when this case is established in Germany? And how does the case of tension differ from the better-known case of defense, which is usually associated with an actual war? The German <a href=\"https:\/\/www.fr.de\/politik\/palantir-deutscher-nato-kommandeur-lobt-umstrittene-us-software-94309562.html\" target=\"_blank\" rel=\"noopener\"><strong>NATO General Kai Rohrschneider praised the \u201eMaven Smart\u201c system\u201c<\/strong><\/a> and spoke of an enormous acceleration of military processes and significantly streamlined structures. The software analyzes data from satellites, sensors and drones using artificial intelligence and is intended to make military decisions faster and more efficient. At the same time, the debate remains highly sensitive. While NATO structures are increasingly using Palantir, the Bundeswehr itself is currently rejecting its direct use. This is due to concerns about data sovereignty and the question of whether external US companies should be given access to sensitive military data. This highlights a fundamental conflict of our time: on the one hand, the pressure to technologically upgrade and automate military systems is growing. The Ministry of Defense refers to improved military registration in an emergency, but at the same time speaks of potentially \u201efar-reaching\u201c effects, while concrete forms and exceptions have not yet been conclusively defined. In the context of this article, the change is an example of how the legal and organizational requirements for a possible case of tension do not develop abruptly, but gradually and often without broad public debate.<\/p>\n<p><strong>03.04.2026<\/strong>: A recent policy brief by the Austrian Society for European Politics (\u00d6GfE) exposes the widespread <a href=\"https:\/\/www.oegfe.at\/policy-briefs\/die-stunde-der-eu-armee-eine-policy-analyse\/\" target=\"_blank\" rel=\"noopener\"><strong>Call for an EU army in question<\/strong><\/a>. Against the backdrop of the war in Ukraine and growing geopolitical tensions, the study analyzes whether a joint European armed force is realistic and sensible. The result is sober: A genuine EU army is considered unlikely to be politically and structurally feasible in the foreseeable future. National interests, legal hurdles and different security policy cultures within the EU prevent deeper integration. Instead of grand visions, the analysis recommends a pragmatic approach. It is used in <a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_80a.html\" target=\"_blank\" rel=\"noopener\"><strong>Article 80a GG<\/strong><\/a> and can be established if a threat situation emerges without an armed attack on Germany having already taken place.<\/p>\n<p>The declaration is made by the Bundestag with the approval of the Bundesrat. The legal basis allows the state to take certain preparatory measures for national defense - even if the actual case of war has not yet occurred.<\/p>\n<h3>The case of defense - when the attack has taken place<\/h3>\n<p>The case of tension is contrasted with the case of defense, which in <a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_115a.html\" target=\"_blank\" rel=\"noopener\"><strong>Article 115a GG<\/strong><\/a> is regulated. It comes into effect if Germany is attacked by armed force or if such an attack is imminent.<\/p>\n<p>Here, too, the Bundestag must take action with the approval of the Bundesrat, although even stricter regulations apply in the event of defense - particularly with regard to the restriction of fundamental rights, the deployment of the Bundeswehr in Germany and the control of the economy.<\/p>\n<h3>The crucial difference: prognosis vs. acute attack<\/h3>\n<p>The main difference lies in the timing and nature of the threat. With the <a href=\"https:\/\/de.wikipedia.org\/wiki\/Spannungsfall\" target=\"_blank\" rel=\"noopener\"><strong>state tension<\/strong><\/a> is a precautionary measure that allows the state to prepare for a potential threat - for example through troop redeployments, conscription regulations or stricter security laws.<\/p>\n<p>At the <a href=\"https:\/\/de.wikipedia.org\/wiki\/Verteidigungsfall_(Deutschland)\" target=\"_blank\" rel=\"noopener\"><strong>Defense case<\/strong><\/a> On the other hand, it is an acute war situation in which an attack has already taken place or is imminent. Both cases activate special regulations, but the case of tension can be determined much earlier and for an indefinite period of time - and is therefore all the more politically sensitive.<\/p>\n<h3>Transitions and risk of abuse?<\/h3>\n<p>As a state of tension can be declared even in the event of a vague threat situation, there is a risk that its application will be politically motivated or strategically overstretched. While the case of defense requires a verifiable attack, the political assessment of a security situation may be sufficient in the case of tension - which leaves room for interpretation and interpretation.<\/p>\n<p>From the perspective of the rule of law, it is therefore particularly important that the application of these exemptions is subject to transparent monitoring - not least by a vigilant public and independent media.<\/p>\n<h3>The case of tension is not just a simulation game<\/h3>\n<p>Although the state of tension may seem like a theoretical construct at first glance, in practice it creates very real powers for the government and military that can have a profound impact on citizens' lives. It is therefore crucial not only to deal with the state of defense, but also to understand this lesser-known state of emergency in detail. Because as soon as a state of tension is declared, the relationship between the state and its citizens changes fundamentally - often insidiously, but with far-reaching consequences.<\/p>\n<h2>What would be the immediate consequences of a declared state of tension?<\/h2>\n<p>As soon as a state of emergency is declared by the Bundestag and Bundesrat, the legal situation in Germany changes fundamentally. This step activates a series of special powers that are normally reserved for a state of emergency. These affect not only the military, but also public life, the administration, the media and the economy. So what exactly happens from the moment a state of emergency is officially declared?<\/p>\n<h3>Extended legislative powers of the federal government<\/h3>\n<p>One of the key consequences is that the federal government will be given significantly more powers, <strong>Enforcing laws at breakneck speed<\/strong>. This means that ordinances with the force of law can be issued - i.e. regulations that would otherwise only be passed by the Bundestag. Powers that actually lie with the federal states can also be centralized, for example in the areas of police, civil protection or healthcare. Article 80a of the Basic Law and other provisions of military constitutional law open doors here that are closed in normal operations.<\/p>\n<h3>Conscription of the Bundeswehr - also in Germany<\/h3>\n<p>The Bundeswehr's range of missions is extended with the case of tension. It can be deployed not only for defense, but also for domestic support, particularly in the event of imminent danger. In conjunction with <a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_87a.html\" target=\"_blank\" rel=\"noopener\"><strong>Article 87a paragraph 4 GG<\/strong><\/a> this can lead to the domestic deployment of the armed forces - for example to support the police or protect \u201ecritical infrastructure\u201c. What was unthinkable for a long time can gradually become reality in this way - legitimized by the case of tension, even without an actual case of war.<\/p>\n<h3>Mobilization: reservists and conscripts<\/h3>\n<p>When the event of tension is declared, the so-called event of tension clause comes into force, which allows it,<\/p>\n<ul>\n<li><strong>Reservists<\/strong> to be convened,<\/li>\n<li><strong>Conscripts<\/strong> again,<\/li>\n<li>and <strong>Civilian alternative services<\/strong> to arrange.<\/li>\n<\/ul>\n<p>This means that even <strong>Citizens who have not been required to do military service for years<\/strong>, could be called back into service. In addition, compulsory military service for young men - and possibly also women via the civil defense route - could be reactivated at short notice. The case of tension allows this even before the outbreak of war, purely as a preparatory measure.<\/p>\n<p>In a previous article, I described which rights to the <a href=\"https:\/\/www.markus-schall.de\/en\/2025\/09\/conscientious-objection-to-military-service-what-to-do-in-an-emergency\/\"><strong>Refusal of military service<\/strong><\/a> are available.<\/p>\n<h3>Restrictions on the federal order<\/h3>\n<p>In the event of tension, the Federal Government can - based on the emergency legislation<\/p>\n<ul>\n<li>issue instructions to state governments,<\/li>\n<li>Place authorities under central management,<\/li>\n<li>and also prepare interventions in judicial processes (e.g. accelerated procedures).<\/li>\n<\/ul>\n<p>Federalism, otherwise a guarantor of political decentralization, is significantly weakened in a state of emergency - partly tacitly, but effectively.<\/p>\n<h3>Interference in the media, communication and freedom of information<\/h3>\n<p>A less well-known but far-reaching consequence concerns the information space. Even in the event of tension, the state can:<\/p>\n<ul>\n<li>the <strong>Coordinate broadcasting<\/strong> or centrally,<\/li>\n<li>Measures against <strong>\"destructive\" reporting<\/strong> meet,<\/li>\n<li>the <strong>Telecommunications<\/strong> monitoring (e.g. mobile communications, internet, messenger),<\/li>\n<li>and even <strong>Internet services<\/strong> regulate or restrict if internal security appears to be at risk.<\/li>\n<\/ul>\n<p>This is legally possible via the Article 10 Act and supplementary regulations in connection with the G10 body and the Security Cabinet.<\/p>\n<h3>Commitment to cooperation - also in business and society<\/h3>\n<p>Under the slogan \"overall defense\", the state can oblige companies and citizens to cooperate. This applies, for example:<\/p>\n<ul>\n<li><strong>Production changes<\/strong> in industry and trade,<\/li>\n<li><strong>Confiscation<\/strong> of operating resources,<\/li>\n<li>or the <strong>Commitment<\/strong> to tolerate state intervention in operational processes, material supply or logistics.<\/li>\n<\/ul>\n<p>Owners of real estate or vehicles can also be obliged to use their property for \u201estate purposes\u201c - in return for compensation, but under duress.<\/p>\n<h3>The state of tension is not a symbol, but a powerful tool<\/h3>\n<p>A declared state of tension has very concrete, far-reaching consequences - not only for the military and administration, but for every single citizen.<br \/>\nIt allows the state to bring conscription, information control and property seizures back to the fore - without a war taking place. But this is only half the truth. The current constitution already provides for special regulations for exceptional situations - including the case of tension. As soon as this is established, the state can intervene in a targeted and lawful manner in fundamental rights that are normally subject to special protection. Which rights are affected - and which are not?<\/p>\n<h3>The constitutional lever: Article 115c of the Basic Law<\/h3>\n<p>The most important legal basis for restrictions on fundamental rights in a state of tension and defense is Article 115c (2) of the Basic Law.<br \/>\nIt states that certain fundamental rights may be restricted \"in accordance with a law\" if a case of tension has been established. The following fundamental rights are affected in particular:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_10.html\" target=\"_blank\" rel=\"noopener\"><strong>Art. 10 GG<\/strong><\/a> - Secrecy of correspondence, post and telecommunications<\/li>\n<li><a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_11.html\" target=\"_blank\" rel=\"noopener\"><strong>Art. 11 GG<\/strong><\/a> - Freedom of movement<\/li>\n<li><a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_12.html\" target=\"_blank\" rel=\"noopener\"><strong>Art. 12 GG<\/strong><\/a> - Freedom of occupation, prohibition of forced labor<\/li>\n<li>partly also <a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_13.html\" target=\"_blank\" rel=\"noopener\"><strong>Art. 13 GG<\/strong><\/a> - Inviolability of the home<\/li>\n<li>and <a href=\"https:\/\/www.gesetze-im-internet.de\/gg\/art_14.html\" target=\"_blank\" rel=\"noopener\"><strong>Art. 14 GG<\/strong><\/a> - Property and inheritance law<\/li>\n<\/ul>\n<p>These restrictions are not blanket, but are tied to legal requirements - nevertheless, the scope for discretion is considerably extended.<br \/>\nFreedom of communication: surveillance becomes the rule One of the first and most visible encroachments concerns the secrecy of telecommunications (Art. 10 GG). Under certain conditions, telephones can already be monitored and emails read.<\/p>\n<p>In the event of tension, however, these measures can be generalized and carried out preventively - even without concrete suspicion of a crime, but purely to \u201eavert danger\u201c. This applies, among other things:<\/p>\n<ul>\n<li>Mobile and Internet connections<\/li>\n<li>Messenger services<\/li>\n<li>Private mail and parcels<\/li>\n<li>Server and cloud access<\/li>\n<\/ul>\n<p>Control is no longer the sole responsibility of independent courts, but increasingly of security authorities and political bodies.<\/p>\n<h3>Freedom of movement and freedom of movement<\/h3>\n<p>Article 11 of the Basic Law guarantees in principle the right to move freely within Germany. However, this right can be restricted or revoked in cases of tension. In addition to military mobilization, compulsory civilian service is also provided for, for example:<\/p>\n<ul>\n<li><strong>Compulsory obligations<\/strong> in the healthcare sector, rescue services, fire department, infrastructure<\/li>\n<li><strong>Relocation or decommissioning<\/strong> of companies if this serves the \"interests of defense\"<\/li>\n<li>Obligation to <strong>Taking up employment<\/strong> in safety-relevant areas<\/li>\n<\/ul>\n<p>Even forced labour, which is generally prohibited by the Basic Law, can be legitimized under certain conditions, for example in the context of \"civil defence\".<\/p>\n<h3>Interventions in the home and property<\/h3>\n<p>The fundamental right to inviolability of the home (Art. 13 GG) can also be curtailed in the event of tension:<\/p>\n<ul>\n<li>Apartments can be <strong>Security or accommodation<\/strong> be used<\/li>\n<li><strong>Searches<\/strong> can be facilitated and judicial orders can be circumvented<\/li>\n<li><strong>Wiretapping measures<\/strong> in private space are possible<\/li>\n<\/ul>\n<p>The situation is similar with property (Art. 14 GG):<\/p>\n<ul>\n<li><strong>Expropriations<\/strong> for national defense are expressly permitted<\/li>\n<li>Real estate, vehicles or means of production can <strong>confiscated<\/strong> become<\/li>\n<li><strong>Compensation<\/strong> are provided for, but do not have to be paid in advance<\/li>\n<\/ul>\n<p>Agricultural products, food, medical supplies or machinery could also be used for \"defense security\".<\/p>\n<h3>Which fundamental rights remain (theoretically) inviolable?<\/h3>\n<p>Despite all the exceptions, certain basic rights remain protected even in the event of tension - at least on paper. These include:<\/p>\n<ul>\n<li><strong>Human dignity<\/strong> (Art. 1 GG) - inviolable<\/li>\n<li><strong>Religious freedom<\/strong> (Art. 4 GG)<\/li>\n<li><strong>Freedom of expression<\/strong> (Art. 5 GG) - however, de facto restricted by media control<\/li>\n<li><strong>Independence of the courts<\/strong> (Art. 92 ff. GG) - whereby special regulations may apply<\/li>\n<\/ul>\n<p>But here, too, the factual approach can differ from the theory. In emergencies in particular, even constitutionally protected freedoms quickly come under pressure - usually due to \u201etemporary exceptions\u201c that then remain.<\/p>\n<h3>The state of emergency knows hardly any clear boundaries<\/h3>\n<p>In legal terms, a declared case of tension means the activation of a parallel order in which central fundamental rights can be restricted or suspended - legitimized by the constitution itself. What many citizens perceive as inviolable becomes a matter of negotiation in exceptional circumstances - depending on the situation, interpretation and political will. It is therefore all the more important to consciously follow these developments, even if they appear to be legally correct.<\/p>\n<hr \/>\n<h3 style=\"text-align: left;\">Current survey on tension in Germany<\/h3>\n<div class='bootstrap-yop yop-poll-mc'>\n\t\t\t\t\t\t\t<div class=\"basic-yop-poll-container\" style=\"background-color:#ffffff; It is no longer just about paragraphs and constitutional articles, but about questions such as:<\/p>\n<ul>\n<li>Do I have to go back to the <strong>Sampling<\/strong>?<\/li>\n<li>Can the state take my house <strong>confiscate<\/strong>?<\/li>\n<li>Can I <strong>forced<\/strong> be forced to work somewhere I don't want to?<\/li>\n<\/ul>\n<blockquote><p>All this - and more - is made possible by the voltage drop.<\/p><\/blockquote>\n<h3>The return of compulsory military service - sooner than expected<\/h3>\n<p>The case of tension allows the state to reactively enforce the suspended military service - without a war taking place. In concrete terms, this means<\/p>\n<ul>\n<li>All <strong>male<\/strong> German citizens between <strong>18 and 45 years<\/strong> can be called up for military service again.<\/li>\n<li>The Bundeswehr can <strong>Call-up notices<\/strong> even if you have never served.<\/li>\n<li>Even former <strong>Retired<\/strong> or <strong>Reservists<\/strong> can <strong>consulted again<\/strong> become.<\/li>\n<\/ul>\n<p>Although women are currently excluded from compulsory military service, they could be conscripted via civil defense (see below). Concrete measures could be:<\/p>\n<ul>\n<li><strong>Commitment<\/strong> for service in care facilities, hospitals, disaster control<\/li>\n<li><strong>Use<\/strong> in food distribution, transportation logistics, infrastructure monitoring<\/li>\n<li><strong>Work commitments<\/strong> in government-related institutions (e.g. energy supply, waterworks, IT security)<\/li>\n<\/ul>\n<p>This means that every citizen can be called upon to \u201ework for the common good\u201c - even without qualifications, even against their will.<\/p>\n<h3>Living space and vehicles: confiscation legally possible<\/h3>\n<p>One particularly sensitive point concerns private property. In the event of tension, the state can:<\/p>\n<ul>\n<li><strong>Confiscate living space<\/strong>e.g. for the accommodation of soldiers, refugees or emergency services<\/li>\n<li><strong>Request vehicles<\/strong>especially vans, off-road vehicles, machines<\/li>\n<li>Land, garages, agricultural land <strong>misappropriate<\/strong>for storage or supply, for example<\/li>\n<\/ul>\n<p>That sounds drastic - but it is expressly covered by Article 14 of the Basic Law in conjunction with the emergency laws, as long as compensation is provided for. However, this does not have to be paid in advance.<\/p>\n<h3>Companies and the self-employed: Interventions in operating processes<\/h3>\n<p>Companies, craft businesses and the self-employed are also affected. In the event of tension, the state can:<\/p>\n<ul>\n<li><strong>Means of production<\/strong> redirect (e.g. conversion to armaments or emergency supplies)<\/li>\n<li><strong>Materials<\/strong> confiscate<\/li>\n<li><strong>Personnel dispositions<\/strong> order, for example for particularly qualified workers<\/li>\n<li><strong>Contractual relationships<\/strong> terminate or adjust, e.g. supply contracts, leases, rental agreements<\/li>\n<li><strong>Price specifications<\/strong> e.g. for \"war-relevant\" products or services<\/li>\n<\/ul>\n<p>This massively restricts economic freedom - even if it remains formally in place.<\/p>\n<h3>Restriction of personal life planning<\/h3>\n<p>The state can use the state of tension:<\/p>\n<ul>\n<li><strong>Exit restrictions<\/strong> issued - no longer a guarantee to leave the country<\/li>\n<li><strong>Reporting obligations<\/strong> impose, e.g. for persons fit for military service or systemically important persons<\/li>\n<li><strong>Travel bans<\/strong> in certain regions<\/li>\n<li><strong>Residence requirements<\/strong> make - so anyone who \u201eactually wanted to move away\u201c can be obliged to stay<\/li>\n<\/ul>\n<p>Students, trainees, pensioners or single parents are not automatically protected either - because anyone can be declared \u201efit for duty\u201c if necessary, provided this appears necessary to maintain order or care.<\/p>\n<h3>Psychological effect: pressure, fear and duty of loyalty<\/h3>\n<p>In addition to the legal consequences, a case of tension has a psychological effect that should not be underestimated:<\/p>\n<ul>\n<li>Public pressure to \"behave loyally\"<\/li>\n<li>Fear of repression if you speak out critically<\/li>\n<li>Social exclusion, e.g. if you don't show up for work<\/li>\n<li>Stigmatization of \"objectors\" or \"deviants\"<\/li>\n<\/ul>\n<p>Although there are still legal options to object, in practice the climate in such exceptional phases is usually repressive and intolerant of criticism.<\/p>\n<h3>The case of tension is not an abstract situation, but an introduction to everyday life in an exceptional situation<\/h3>\n<p>What sounds like a technical measure on paper means far-reaching changes in everyday life in practice: Sudden call-up. Compulsory service. Property under state control. Freedom of movement restricted.
